Same way you can't sue a stockbroker for unsolicited orders. "False plays," are what exactly, in your estimation? False because they lost? That's weak. Bottom line is, to republish the analysis is certainly copyright infringement - they're words and expressions written by an individual - be it they're right or wrong. To say so and so has a play on this game, it doesn't necessarily sound like a big deal. Is it right? Not really. But the bottom line is, the people who are suing this site haven't figured it out yet, that the people who visit this site don't purchase service plays anyway - that's why they're here!
Wrong you can sue anyone for anything.

California people sued Casino's or was it there Visa card companies for gambling losses that they incured while playing online casinos.

We've most all bought many a play....who's to say who bought what? Are they weak enough to think, we think, we buy it, it's ours to do with what we please.
Prove I/we/you didn't buy it, then sue.

          can't wait for Monte's story.
Actually what you said isn't true, but I don't want to go into detail about that.

            • One final note.

I went back to DBS and found that my total expenditures over the last 12 months was just over $3600. The total won/lost record was 61 wins, 62 losses for 49%! Maybe these guys arent worth it. Duh! Like someone said, the cappers on this site are pretty damned good, and maybe we should look amongt ourselves instead of at these high priced rip-off services! BEST TO ALL AND THANK YOU!!!

              • Put a stake in the paid services;they are for all intensive purposes;this is nothing but a last gasp effort;somebody will ultimately take them up on their threat, and then they will be even less important than they are now.
When the reasons are stated for the end of the service thread, and everyone finds out about them, the paid services will tarnish their image even more and will be even more on everyone's sh-t list.

                  • Unfortunatly I don't think many of you are clued up on what is and what is not copyright. If a capper posts a play on his/her site or one that they are attached to, that is still copyrighted and does not give you permission to copy any part of it. When monies are involved (purchase for paid picks) you are participating in a binding contract. Each of these plays are copyrighted as the capper has a time stamp of when the original was posted, ie: in the form of an e-mail or posting into a sites system. Clearly that time is recorded. Everything, including the cappers name is under copyright law for that particular posting.

It was not long ago that a forum owner in Australia was sued and he lost big time for having plays posted on Aussie Rules and Rugby. Some contained writeups and others just the cappers name and play.

So before people comment and say, call their bluff, way up the options, do you want to take the gamble.

It's not your site, not your money. What would you do. I am sure 99% of you would stop and run, the other 1% would be bankrupt via lawyers bills alone.

Well said Stars n Stripes. I will say this again. There is no way in hell the forums could win such a law suit. They know it and their attorneys have confirmed it. Just because we don't like touts doesn't mean we can violate their rights. Unfortunately.

If services don't want their plays out there then I strongly suggest they go to the consensus sites as that's where 99% of the plays come from!
