i'm not getting into a pissing match with everyone cause everyone has their own opinion.
i had a dui in 2006 and had no priors in ANYTHING and i got 60 hours of community service and 5 years probation and i was lucky and haven't had a drink since.
the bottom line and NO ONE can argue this is that MONEY and MONEY only made this sentence possible. if stallworth would have been an "average joe", no matter how remorseful he is, he would be in jail for at least 5 years - intent or not - he would be in jail for 5 years. MONEY made this happen
Big difference guys. A dog didn't run out in front of Mike Vicks car. If it did, we would all probably say well, it was just a dog. That is how you guys are treating it. What Mike Vick did wasn't an accident. It was premeditated ... over and over and over and over again. That is one fucked up mind right there, not the guy who walked the fine line of .08 and DUI.
If you sit in a bar all night drinking your face off knowing that your car is parked outside and you are driving it home - is that premeditated? Think about it!
And Stallworth's .126 BAC was not a "fine line of ,08 and DUI" - he was not just legally drunk he was DRUNK!

I can tell you from personal experience in taking the test that it IS a fine line. Maybe 2 beers. I took the test. Did you? If you didn't, you have no clue how fine a line it is. Andrew Gallo was .24 when he killed Adenhart. That is "Drunk".

Been there and done it - the number of drinks that needs to be consummed to register a .126 versus .08 is different for everyone and primarily driven by body weight - as a matter of fact the term "drunk" is different for everyone - it is not a science or based solely on number of drinks but rather how much that indiviual can tolerate - for some it may only be a half of glass of wine and for others like me it could be 20 beers (lol). The law establishes legal limits based on the average of the masses and is used as a guideline for situations like this. Bottom line, whether it took Stallworth 2 beers or 20 beers to get to .126 is irrelevant but what is relevant is that by LEGAL DEFINITION he was DRUNK! On that note I am going to have a cold one! lol

I got a dwi about four and a half years ago when i was 19 years old. I was going to school at the University of Buffalo at the time and i had planned on driving my car from the north campus to the south campus where all the bars and parties are ect. I INTENDED on leaving my car down there and taking a taxi home. Well i parked my car at a bar and walked down the street to a freinds party where i got completely obliderated. I was blacked out drunk by about 11pm when we decided to go the the bar where my car was parked. This is all second hand information because as i said i was blacked out. Well after about twenty minuets at the bar I for some crazy reason left the bar with out any of my friends knowing and got in my car to drive home. I somehow made it pretty far but ended up totalling my car and causing thousands of dollars in property damage. Again this is all from the police report. I did not take a breathalizer and apparently told the cop "im not taking that shit pig" something I WOULD NEVER SAY!!!! I do not remeber anything about the incident. Im sharing this with you guys because you cant just say o he drove to the bar so he knew what he was getting into. I think these situations need to looked at differently depending on the circumstances. In my case I feel i planned accordingly but when you drink THAT MUCH THAT FAST its like another person because you have no idea what you are doing. The most important thing is to keep your self somewhat under control when drinkin, partying ect. I still drink a lot but i never let myself get to the point i was at the night i got my dwi. In stalworths case i smiply think he may have had a few drinks and he thought he was okay to drive. Obviosly he was over the limit and its a shame he had to hit that guy but how many of us can say that something like this couldnt happen to any of us TONIGHT! I feel if the family of the victum is satisfied with the result then the justice system did its job. I hope stalworht learns his leasson. I know i learned mine...i didnt kill anyone but i so easily could have its not even funny. When you think of it this way drinkin and driving is a scray thing. This is a really great thread and i enjoyed reading everyones comments. I think you all make very valid points, i just thought my story would bring some light to the convo. My penalty was a few thousand dollars in fine, lawyer fees ect., inflated insurence due to probation for five years and i lost my liscense for one full year. Seems like stalworth did get off a little to light as far as only 30 days in jail where i was close to spending 30 days in jail fo the property damage.

If you have ten million dollars and want to have a drink with the guys, spend 10 bucks for a taxi. Do this and a live is saved.
However, I do agree with everything else you said in your post. And you are right, if the family is satisfied, who are we to be upset.
