They did investigate. The police were on the scene. Their report state ALCOHOL WAS NOT INVOLVED! Maybe it was. Maybe it wasn't. Assuming he was drunk, they can no longer arrest him for DUI. They have no proof.

Unfortunately, a close friend of mine got a DUI on a fucking golf cart. I can't tell you how many times she heard "well you coulda hurt someone". I've seen people get DUIs on fucking bicycle. Why? Just because the cop could.
