Don't laugh. If it ever went to court, I might very well have argued the mental anguish I went through about the possibility of having to give up my beloved cat or be fined, arguing that the salesman(who was hired by the owners and developers of the property) was instructed to sale the units even if it meant not being completely honest and forthright when questioned about whether I could have an indoor cat or not.

I'm laughing out how long this thread is going on, because I do believe you could argue mental anguish lol

Since this topic is pretty much is exhausted, I would love to hear sopme of you other guys tell a story in which you think you were mistreated and/or not judged fairly.
It doesn't have to be as detailed as mine-just a simple incident which occurred in your everyday life-what the outcome was and what you think the outcome should have been.

I still can't believe you thought you were mistreated. You should have thanked them for letting you break the rules for 7 years and keeping a cat.

As far as mental anguish goes? The judge would save you some after he ruled against you by getting the shitbox out of the house!

Once savage went before the board the board had a Statutes of limitations on when they could try to do something. Shit though this was back in 1987 so they may not let savage move back there.

Very provincial, shallow and and one way thinking-not once did you address the point about the cat being considered personal property by my attorney nor the fact that the other lady was allowed to buy her way in with her cats, whereas I was not.

I am going to sum up my feelings by stating as I just told Wayne that no one answered as to why the point my attorney made about my indoor cat being considered personal property and thus off limits for that reason alone.
Remember this was a condo OWNED IN full by me at the timeand NOT an apartment owned by a landlord.
Also no one answered the unfairness of the Association secretively allowing to buy her way in with the cats while not allowing me to do the same.
Until/when/if someone can refute these points(this has nothing to do what the salemans said, which is another matter), I will conclude that they are valid points.

Don't need to. The other lady has nothing to do with you and the paper you signed. The judge doesn't/wouldn't care about her either. You could have 3 cars that are personal property too but if it states a 2 car maximum, you would have to find a place to put your 3rd car. I'm not stupid savage and i owned a condo myself and i had to follow the association rules. They think they are king shit and they have their stupid monthly meetings. They think they are much bigger and badder than they are. I know all of that and all about the rules. Mine didn't allow any pets either. We all signed the association agreement and i'm sure you did too. Bottom line doesn't change. You are wrong and they can enforce a policy that you signed at any time.

The other lady has PLENTY to do with the case considering that they were breaking their own bylaws by allowing the lady to have two cats while stating when the incident took place that pets were not allowed, period.
Finding a place to put a third car is not quite the same as an indoor cat, which is my property and which is contained within the confines of my property.
They didn't pursue it any further because they realized they had met their match(for a change) and knew they were beat based on what I and my attorney said.
I was happy with the outcome, namely that they chickened out, and that I kept my cat and no further threats of fines.
On the other hand, it would have been fun to kick their ass in court and humble them, something which probably had never happened to them in their miserable lives.
We will never know what would have happened of course because the cowards walked away.
My attorney and I made our points well, and it was telling in the results-that is all that really matters at this point.

The cat told me to tell the Association that she would claw the eyes out of the lady in charge if they pursued this matter further-that is the real reason they chickened out.

Wrong again savage. I lived in 2 different condo associations and both had no pet policies. Both also had residents with pets. Most overlook it or do not make a big deal about it until the pet either causes a problem or they receive complaints about it. Once that happens, the policy is listed so they can enforce it. Once they enforce it, that then opens the door for all other there that own pets. The reason why they left you alone was because you went fucken ballistic over a cat and acted like a lunatic. I'm sure at that point they probably agreed to just leave you and your fucken house cat alone. It certainly wasn't because they couldn't pursue it, it was because they chose not to. Plain & simple and you should have thanked them AGAIN for saving you more embarrassment. All they have to say about the other lady is that she was notified too and being dealt with. After that, the judge would have moved on and not given 2 shits about her. Keep reaching savage. You signed it and you broke the Association laws. It's right there in blue or black ink buddy. Can't do much about that. Next time use a pencil i guess!

What if the cat died and you just left it there rotting and stinking up the whole building? Are you just going to argue that it is your personal property and you are entitled to keep it?

What if you kept a young Cuban boy as a sex slave inside your place as personal property. You gonna tell the police it is your personal property, they can't touch it.

Arguing that a cat is personal property and not subject to a signed contract is idiotic, and no rational person can think that is a reasonable argument. If that was the case what would be the point of having any rules if you can just say it is your personal property to get around it?

savage i had rental property for 25 years,i had a no pet policy but everybody broke it,i finally just started charging a big non-refundable pet deposit up front, have no clue if that was legal or not, anyway condos and apts are two different ballgames !! the main thing with rentors was to make sure you didnt get maniacs that would terrorize your property-good referals are a must in that game, but in 25 years i went to court one time over a bad check, back in the old days if they didnt pay we would move their stuff out on the street-THEY WOULD OWN YOUR ASS IF YOU TRIED THAT UNDER THE MODERN LAWS,BUT LIKE I SAID CONDOS AND APTS-2 DIFFERENT BALLGAMES-I THINK YOU HANDLED YOUR ORDEAL WITH DIGNITY AND CLASS-ANYWAY THATS MY 2 CENTS !!
