what most may not be picking up in this case is that Phillips would be considered a supervisor to that girl and when it come to sexual harassment in the workplace, the supervisor is considered in the wrong because the subordinate could possiblely say she was afraid to say no because she would be afraid to get fired.....it happens...

He has absolutely NO grounds for a lawsuit. He can try, but he won't win. Not to mention he had a history of inappropriate behavior with the Mets with a woman even uglier than this current one. No court is going to reward him for having an affair twice with two separate companies.....

I had mentioned that above. He would have ZERO chance of winning a lawsuit against ESPN. Even if she didn't get fired.

I'm just here so I won't get fined....

Looks like Stevie has a thing for the nasties. What is wrong with that guy? His wife appears attractive enough.

First as I stated I don't know the facts of this case.

You are dead wrong. At Will is not iron clad. You can't fire someone just because you want to fire them. Contract or no contract. If you fire an employee due to discrimination, retaliation, etc an employee has grounds for wrongful termination.

If two employees have an affair. One employee gets suspended then fired while the other employee faces no repercussions then one unquestionably has a potential case to file wrongful termination on the basis of discrimination. If the employer fires both employees than there's no grounds for a lawsuit.

Again as I stated I didn't know the facts of this particular case. On the facts you presented I do agree with you. If he's in a position of authority over the employee and he's had prior history of inappropriate behavior then his chances for a successful lawsuit is slim to none.
You're both wrong as there's always a way for a Lawyer to find grounds to file a Lawsuit. No the question is can they win? Or will it get thrown out by the Judge which then in turn the other side could ask for Attorney fee's etc. for a frivolous Lawsuit.

Zero? Are you kidding me. His chances would be low, but how much is ESPN willing to spend fighting him vs. just paying him some money to shut the fuck up.

Actually I won't be surprised if she sues ESPN. Matter of fact if both of them sue ESPN.

GL with that. ESPN has the means and money to drag it out until both are broke!

What you don't get is that the Lawyers representing them will take the case contingency . And they both can drag it out.
