Gun laws in the United States (by state) - Wikipedia, the free encyclopedia
What are the Gun Laws in New York?
Firearm Laws for New York
They appear to be pretty strict on gun laws especially hand guns. I don't see what the penalty is for carrying a hand gun without a permit. Did he have a permit?

The gun permit was for Florida I believe. I really feel sorry for him. 2 years is a long time when life is so valuable, especially in your prime years.Originally posted by BettorsChat View PostGun laws in the United States (by state) - Wikipedia, the free encyclopedia

I believe Stallworth scratched a HUGE check to the family of the guy he ran over and killed (by accident) as a part of his plea agreement for a lighter sentence which the victims family was down with. Had it been anyone else that killed someone like that who didnt have the money to pacify the family of the victim they whould most likely be doing time in the jointOriginally posted by frankb03 View PostI agree! This is a joke! Two fucking years for being an idiot. Stallworth kills another human and gets 22 days. Where's the logic?

Correct, it was a Florida permit that was expired. And concealed carry permits don't cross state lines anyway. He obviously did way less than someone like Stallworth, but NYC is NYC law.Originally posted by weazel079 View PostThe gun permit was for Florida I believe. That law was part of their plan to clean up the city to make it hospitable again, and it really worked. I felt 100 times safer in downtown there last year than walking around downtown Cincinnati. And that 100 times is no exageration.
Ignorance of the law is not a defense and, unfortunately for him, he broke the law in a place with strict sentencing. It's certainly not "fair" compared to other actions/people, but it is what it is.
Also, with good behavior, he'll be out in 20 months.O..H.........I..O!

well put apples....the laws differ in each city, state.....i wish they would be the same for the guns carried (unlawfully).. i dont understand why athletes dont hire bodyguards if they feel the need to carry a gunOriginally posted by ULikeApples View PostCorrect, it was a Florida permit that was expired. Maybe Plax should have thought it out a little better. No one at da club reported a shooting. He should have said that he shot himself at his home or somewhere else. If he would have done that he'd might be playing this year. From what I heard they got tough on this because of the P Ditty and J Lo incident that happend in a NY night club a few years back. Seeing that neather of those two got anything I guess Plax is the example.

ok here is my 2 cents. NYC law requires a minimum 2 year sentence if convicted of carrying a unregistered firearm it is a felony. The thing is and I'm only getting this from my cousin Aaron who is an attorney here in NY. We of course discussed this topic at some length. He told me that if it is a first time felony conviction and you have no priors you will NOT i repeat WILL NOT get jail time PERIOD. You will get 2-5yrs probation and a hefty fine. No one goes to jail for carrying a unregistered weapon as a 1st time offense if you have no criminal record. It does not happen. He wasnt involved with any drug possession or murder or rape or assult to go along with illegal possession of a firearm. The reason we believe his attorney didnt press for no jail time is because they knew it was a high profile case and if they lost which he could have he would be looking at 4-15yrs in prison minimum which would end his football career, as opposed to 20months. Bottom line is Burress is being used as an example. Why? cause he is high profile and an easy target to set up as an example for the future.
i think he got hosed. IMO2013 NCAA POD Record

I am not condoning what Buress did - he was wrong - but to me the punishment does not fit the crime.
I know laws are different in each state but Buress is more guilty of stupidity than anything else.
There are 3 cases that seem really out of whack to me.
First, Vick gambles on and kills and tortures dogs and serves 18 months.
Second, Buress shoots himself, and endangers others and gets 2 years.
Third, Stallworth kills a guy and admits being drunk and gets 30 days.
I just don't get it. Now I know some of you will say that Vick had "intent", which he did. And that Buress endangered others, which he did. But you can't tell me the end result, and to me that is the bottom line, that the end result isn't worse than what Stallworth did. And don't give me the bull about intent - when you go in a bar, your "intent" is to drink and the end result of his "intent" killed a man.
I know the guy he killed was jaywalking, but I also know if Stallworth wasn't drunk, he might not have killed him. The reaction time could have changed many things.
Again, you animal rights people don't get pissed because I love animals also (ask the goats
) but to me, killing a human being is more tragic than an animal. Both are wrong, but which one is worse?
I'm sorry, Buress is more guilty of stupidity than anything else and I just can't see where the punishment fits the crime.jc Wishes He Can Get A Goat

I could not agree with you more Dave when you say "killing a human being is more tragic than an animal" ... But running over a dog and killing it while driving is a little different than what Vick was doing ... don't you agree??? I think Vick got what he deserved ... he should not even be in your line-up ... why?? It is called intent ... he knew what he was doing ... did what he did because of greed ... he intended to massacre those animals ... he is an asshole and I hope he rots in hell ...Originally posted by baseballdave View PostI am not condoning what Buress did - he was wrong - but to me the punishment does not fit the crime.

No sentence is too long for idiots. He made a mistake? Carrying a loaded weapon into a club is a mistake? If you're not legally allowed to do something, don't do it, or go to prison. Running around with loaded guns is retarded. He knew what he was doing, so no one should feel sorry for him. It wasn't a mistake, don't believe that. The reason people carry loaded guns is to shoot someone if they feel they have to.

I agree Joe. What Vick did was wrong, uncalled for, assinine, etc. and I agree with the sentence he got.Originally posted by Spark View PostI could not agree with you more Dave when you say "killing a human being is more tragic than an animal" ... I used him to show that I feel that Buress really got screwed and that Stallworth's penalty wasn't nearly enough.
My point is where is the justification of Buress getting 2 years for being an idiot - I know he did commit a crime - and Vick getting 18 months - which I think he got off lucky - and Stallworth getting only 30 days.
ALL THREE had intent to do what happened. Vick had intent to torture, kill, and abuse animals and deserved punishment. Stallworth had intent to drink and his intentions killed a person. Buress carried a gun into a night club, and we don't know his intent, but I don't think it was to kill anyone, and he shoots himself and gets more time than the other two.
I just don't get how the crime fits the punishment.
just my opinionjc Wishes He Can Get A Goat
