NEW YORK - A federal appeals court Friday granted Dish Network Corp. a full-court review of a ruling that threatened to force the satellite TV company to disable millions of its customers' digital video recorders because of a patent dispute with TiVo Inc.
The U.S. Court of Appeals for the Federal Circuit in Washington gave Dish a surprise chance for a better outcome in patent litigation that Dish has consistently lost to TiVo. Dish had asked for an "en banc" review of the case while CEO Charlie Ergen resisted paying TiVo damages that have mounted to about $400 million. Ergen had even said the appeals court was unlikely to grant the review.
TiVo shares fell $7.23, or 42 percent, to $10.16. Dish rose 94 cents, or 4.3 percent, to $22.90.
But it's uncertain whether Dish will eventually turn its loss into a victory, given that TiVo has prevailed in a series of other court rulings.

It's a dice roller IMO. Could pay off nice and could kick you in the groin real good.

It should be good news, it depends on who buys them

if it is public knowledge that the company will get bought out, that is already factored into their current stock price imo and the stock will not move either way that much

depends which account i buy out from. For my retirement account i would not buy it, but in my regular margin account i always take chances with these type of stocks...

The idea behind the promotion was to offer as many eight-ounce (237 mL) cups of Stroh's beer as the fans could drink for just 10ยข each, thus increasing ticket sales. Ultimately, the game was forfeited to Texas on the orders of home plate umpire Nestor Chylak because of the crowd's uncontrollable rowdiness, and because the game could not be resumed in a timely manner.

The move up is probably factored in already.
