Normally When A Dog Attacks Regardless Of Being Provoked Or Not, The Result Is You Have To Destroy Your Dog, Give Your Dog Away, Or Accept Exclusion On Home Ins Policy, Once A Dog Attacks He Is Considered Vicious Thereafter Therefore An Owner Of Said Dog Would Be An Idiot To Keep The Dog Because You Have Surrendered Without Question Any Legal Defense Once Your Dog Attacks Another Human Or Animal..........hate To See You Waste Attorney Dollars On An Issue That Favors You And Your Pet From The Get Go

He could always get Attorney Fee's in this Case as well. That is all up to the Judge and Case Law.

Bud, thanks for the great advice, but attorney is an old buddy who will take care of me......I agree...how much is overkill, but i prefer to dot all my 's and cross my t's, since it has been a jursidication issue from the beginning....the state police have tunred away from it..until they found out i was invloved in a fight with the dog....now the animal control officer from union has issued the penalty (town where it happened) and now the ACO from Ashford has to execute the quarantine or other penalties on the dog since that is where it resides.....However, these are part time positions and i have talked to the answering machine many times so far and these country bumpkins are slow to the draw and getting shit done....One thing....my guy gets shit done....so i do not mind the few bucks for the peace of mind...I will just jump on one of Waynes tooth pullers and that will cover it....ha ha!!!

you guys have been great since i knew shit about this

          Tony,
you should have kicked the dog in the nuts or grabbed his nuts, if it was a male, he would have slowed down for sure.
These dogs are very powerful with lots of muscle and fighting them is crazy. You need to hit their weak points, like their eyes and throat and if really need be, snap their legs. In the spot you were in, any of these tactics would have been justified on your part. Who you should hunt down and kick ass on, is the friggin stupid owner who doesnt know how to control his own dog and you are right a kid would have been dead. In fact it was Presa Canario Canary mastiffs that killed that lady out in san francisco.
Am a dog lover and always have golden retrievers, which are very friendly.
good luck Tony and hope your dog is doing much better

            Tony,

Sorry about your dog bro...I know that females can be over aggressive towards on another..I have to be cautions with my German Shepards when another female comes around, however that owner needs to be talked to, no dog should be that aggressive unless in heat...take care

Just keep your cool brother!! When the kids dogs went after us, I got in trouble for going after the kids. Be smart, your right, it may take time, but it will work out. When all is said and done, the other dog will be farmed or destroyed. It makes a big difference that the dog went after you...way too dangerous for that dog to be loose.

One other thing Tony, since you dont carry weapons when your out jogging, you should at least carry a can of strong mace with you, especially out in the forest. small stun gun is even better.

when the jaws are clamped on your dog it is hard to look for his nuts...ha ha.....if i grabbed an arm or a leg it would have surely spun and head up with a dog the odds swing in his favor.....so i tried to work the head and then the throat.....mace would not have helped as i would have been blasting my dogs face as well since he was inside her face to throat......all i can say is there is alot of should of's and could of's and the TRUE FACT is you have zero time to think and all you can do is react...when i was on its back i was fighting it like i would in brazilian jujitzu...i was trying to cut its oxygen and very very luckily it worked.....believe me i wish i could have shot it....or snapped its neck....but i was in a ZONE...and i am glad its over...thanks for the thoughts

I am a bull mastiff owner and i must say they are the loyalist dogs around. I have seen my dog attach someone when they come into their domain, but does not bother anyone he already knew. My dog grew to 180 lbs. and was strong as hell. Just recently my dog had hip replacement surgery and ligament surgery because he is so big he has a hard time carrying his weight, add to the fact that while climbing down or should i say running down the stairs he slipped and hurt his hip and leg. The surgery cost me an arm and a leg but it is well worth it. Cant wait till he gets better so I can breed him with another mastiff. Sorry to hear about your dog. Hope all is well.

i am waiting for the dog warden to give me the exact breed....like i said before i had not seen that breed before and went on the internet to match up as best i could...it was definitely not 180 pounds....my guess is 120 pounds,....my dog is like 82 pounds....but very passive....I also would spend whatever money to fix my dog......I maintain this is the owners fault.....i will post some photos of the injuries tomorrow....Good luck breeding....
