The people that the lawyer told me to contact is the insurance company that I have been dealing with since last year when all this happened, he just said he dont have the authority to offer me more, but the insurance co that I have been dealing with does. Should I not contact them and see if they will give me a new offer without a laywer and if they dont then get one

You are on a very slippery slope. I can promise you that. I've dealt with Comp myself and known many others who have as well. They don't think twice about screwing you when they see a mistake or wiggle room. You better be careful.

I definately think they are going to be pissed that you turned down an offer that was already agreed on. You call and say you want more money and they might decide to start playing hard ball with you at that point.

Yea im gonna talk to a lawyer here in a bit and ask him what he thinks is the best coarse of action..Wayne dont u think the situation changes since they let me go from my job after we agreed on that amount, i took alowball offer because i didnt want to stir the pot at my job and possibly be given a hard time.

The lawyer who told you to contact the insurance company WORKS for the insurance company. It is his job to go back to them and tell them you asked for more money. This is a RED FLAG moment. Get the lawyer and DO NOT contact that insurance company. You might say something that will hinder your case.

You just cant say you want more money. You have to list why and what for and the amount. This is where the lawyer comes into play. They know this game.

Technically, he didnt agree to anything. As long as he didnt sign any papers to settle the case, he can fuck with them as much as they are fucking with him.

Yes it is. Because you should be getting more. These insurance people know how to manipulate this system. This is why they have lawyers for BOTH sides and they have Workers Comp. officials to overseee that you get fair representation from your lawyer as well as from the other side.

When you contact the lawyer, make sure you have your case number

A copy of the 30C form when the injury 1st happened

All the doctors/hospitals/MRI's/Xrays you have seen and been to

Whatever info you have on this case, make sure you give it to him. He will call and get all the info anyway, but dont leave anything out. All records & papers are important.

Yea guys this is confusing, the reason it is taking so long is because i am meeting with this companys attorney, and he has been tied up on trial for another company and said he just now has time to meet with me. This is not a union job, and they said i was laidoff because we slowed down on work, but i have been alot longer than other people and had more responsibility than other people. I think they laid me off thinking since i said i would accept the offer {the lowball offer} I wouldnt go after anymore money, bit now the situation as changed. I have to meet with their lawyer and a arbitrator{neutral} in about 2 hours. They only kept me working about 2 weeks {at the most} after I said i would settle[just seems like it was convienant timing 4 them to do this

I may be sticking my nose in where it don't belong, (again) but I think based on this comment, you may want to check out "American with Disabilities act" also. Sounds like they got rid of you because of a work related injury. That sounds very bad to me. JMO, Good Luck Coach!!

The Insurance Company is the one paying the money. So it won't do you any good to talk with them.

I realize that but verbally, he agreed and they were ready to close the books on it. I'm not sure "Fucking" with them is what he wants if he wants a solution to this. They hold the checkbook and that won't help him any.

well guys i was goin to meet with alawyer tonite, but just got a phone call from the people that deal with my former employer{not an insurance co and not a lawyer} more like a mediator, and asked what changed my mind from the original deal, and I told her what happened and what I thought, and we started talking about raising the settlement amount, and we went back and forth and i ended up getting a another 9% added to the original offer which is 2% more than I was actually going for, so I guess it worked out. Again thanks everyone for your input.

yea im sure I will, my arm is in pretty good shape, only lost a little bit of strength, actually thinking of going back to school to get my teaching degree, and with this settlement it will be all paid 4
