Start keeping a journal of all of these things you're mentioning above and make it very detailed.Originally posted by bryce View PostI just feel that they are taking advantage right now..I have had comments like they were pissed whn you got hurt...I have had additional comments from my superiors that I need to start doing this and that...after 12 years doesn't make sense...today in a meeting they asked if I was still walking with a cane or crutches....I said today a cane...yesterday crutches...I have been in so much pain I had to use the crutches yesterday---thanks for the reply

They sent me a job description one that I have seen many times before and added two line items and said your doc has to sign off on these before you come back...two which are very questionable as what I can do. My doc signed off on them because I asked him to. The day I returned March 16th they told me my job had changed and these were my duties...they said when I was off they determined I wasn't the right fit for the job...WOW--I was flabbergasted. they walked me around my warehouse 3 times during that morning as I am walking with a cane...I was hurting but did it because I knew what was up...they were testing me...I agree they want rid of me..the new regime is in at my comapany and want to rid of the older people that have been there or so it seems.Originally posted by wayne1218 View PostBRYCE, Have you asked them why or told them you came back assuming you had the same job and would be able to do it? If not, you need to just to see what they say. I agree with Monte, it sounds like they are trying to black ball you big time. I know in my dealings, going on disability was a bad thing for just about everyone i've known. It is step 1 of their process to get rid of you.

Thanks buddy! Appreciate the reply...seems like I am on the right track with what everyone is saying...thanks again!Originally posted by insidethe8thpol View PostI am not a lawyer either, but here are a few things you must do:
1) get everything in writing; tell them you want to know why they changed your job detail --- when you ask them questions, ALWAYS put it in writing; make a copy for you, make a copy for them to fill in the blanks and make sure they give it back to you.
2) make sure you have everything in writing -- dates, times, with whom you spoke to, etc.
read this website. its the Americans with Disabilities Act
ADA Home Page - ada.gov - Information and Technical Assistance on the Americans with Disabilities Act

Having the doctor sign off is not a good thing for you at this point (IMO). That's tough and you can bet they are holding that in their back pocket. Alot of companies have an employee get hurt and they consider them damaged goods at that point. If the company feels like they could cut a position or two, you are first on their radar 'cuz to them, you are a headache right now. Them having that Doctor's note is tough now. It's too bad that you work for a company that treats people like a number and not a person.Originally posted by bryce View PostThey sent me a job description one that I have seen many times before and added two line items and said your doc has to sign off on these before you come back...two which are very questionable as what I can do. Agreed Wayne--after all the traveling and the hours I have put in I feel like I am put out...It was stated today that they don't know what the doctor determined but I have a note from him and they can't do anything abt it...they want me to see someone else but can't force me...I said I wouldn't see another doc. I said I will weigh out everything--get me what I can get on disability...SSI ---401 K the whole nine yards and I will think about it but I am not going anywhere...Originally posted by wayne1218 View PostHaving the doctor sign off is not a good thing for you at this point (IMO). Bryce, you said you are an operations manager for a Fortune 500 company. Are you the only operations manager nationwide for the entire company. If there are other operations managers find out if these new duties were added to their job description and if so when. See whether you have been singled out for disparate treatment.

Might be hard to do as they will know what he's trying to prove.Originally posted by ravenmaniac View PostBryce, you said you are an operations manager for a Fortune 500 company. Mark, do you have any really good friends that work for this place that you can trust? If so they may be able to find the above info out for you.
Also if you can get anything on a tape recording about the company complaining about your work ethic since your injuries that would help too.

We are a free standing facility that are unlike the others...we had some before like mine but now unfortunately are under our own umbrella. I thought of this too...but too late to get a job desription from another ops manager....I believe I was singled out...let me retract that I know I was singled out and that is why I contacted an atty. Thanks Raven!Originally posted by ravenmaniac View PostBryce, you said you are an operations manager for a Fortune 500 company. Are you the only operations manager nationwide for the entire company. Monte--right now with being off for 6 months I don't know who I can trust. It is unfortunate that I cannot even go to my HR dept because I don't trust them...I have been in management for 12 years and I can assure you the relationship between managers and HR are pretty tight. I used to be tight with them but right now---not so sure. As far as work ethic nothing has been said...I had a meltdown on this conference call the other day stating that I have been here for 12 years and I do not want to walk away.. They kept insisting that my health was more important..I said yes but I didn't expect to be demoted when I was off and didn't expect a change in duties..they keep pushing for this disability. I mean they seem sincere abt it--my health and all---but I know these people to well...I hate to sound like a sour grape but seriously I know when they are ousting someone and I know how they operate...been there two long...and sadly I was on that side of the fence at one point..

I thought there was but it seems since I left he and the guy that replaced me from corporate have got awful tight...this same guy did tell me that when I came back that they were going to make me walk around the170,000 sq ft warehouse at least three times to test me and see if I could do it....and they did that...I fkng hurt for days...maybe I should be on disability--all I know is they changed this on me when I was gone..I just don't know---appreciate all the feedback I got from everyone! You guys are the best!Originally posted by wayne1218 View PostI thought the same thing Monte. If you have been there awhile, there has to be someone you can trust/talk to.

Been in Management for years and have been through these types of things. If your other facilities are not requiring their Ops Mgr's to do the same thing and you have a good work history that is documented, you have a case plain and simple. Get a GOOD attorney, but only if you are ready to do battle, because once the attorney get's involved it will all be handled by the suits and relationships do not matter! The only scary thing is that with economy the way it is they may claim that this move was necessary to consolidate job functions, but they better be doing it at the other facilities. Hope this helps. Best of luck to you!!!!Originally posted by bryce View PostWe are a free standing facility that are unlike the others...we had some before like mine but now unfortunately are under our own umbrella. This part leaves them open for some liability if you where given high marks on your previous evaluations. This seems to be quite glaring. You just don't all of a sudden determine a person is not quite right for the job if you have been performing these duites for years. Stay positive and perform the est you can, but seek outside professional help that you can TRUST!Originally posted by bryce View PostThey sent me a job description one that I have seen many times before and added two line items and said your doc has to sign off on these before you come back...two which are very questionable as what I can do.
