  • Anyone know anything about disability??

    I live in Ohio. I am an Operations manager for a fortune 500 company. Anyhow had an accident and finally after 6 months went back to work...they changed my job on me--gave me additional things that they know I can not manage--I thought I would have my basic desk job back running day to day stuff but as I said CHANGE big time...today they say they are worried abt me...that they see I am in pain and want me to go on disability until I get better which is abt 60% of my salary..they say I can make up the rest with SSI---I guess I am pissed that they changed my job requirement when I was gone..and now this...I mean for some people it would be a no brainer and they would take it...I did love my job and really do not want to go the disability route...anyone please shoot me a reply if they know anything about this and their thoughts...hey I am asking a bunch of people I don't know personally but many of you I talk to everyday...just looking for some feedback...THANKS!!

    If you lived in my State I could hook you up with some Lawyers that you could run this by as you could have a Lawsuit, because it looks like they may be trying to get rid of you. You go on disability like they want that helps their case out more for being able to fire you.

    Do you not know any good Attorney's in your State/City? Or anyone that does? Also since this is a big company you can contact your local Equal Employment Offices:

    Contact EEOC

    Also I would suggest contacting both your Congressman and Senators offices for advice. Just be careful on what you say.

          That 60% should not be taxable. Depending on your tax bracket that may be as much as 80%. If you are totally unhappy with your future, take some online classes (while you are receiving disability) and find a field that would make you happy. Corporate America can be brutal at times...especially in this market. No use in adding mental pain to go along with your physical pain. A Fortune 500 company should have an excellent HR department...trust but verify. You have a lot of rights. No need to get an attorney involved unless you are really unhappy with the results.

          I am assuming that the accident was not job related. Different story if it was.

            I did contact a atty. I haven't spoke to them yet as I talked to a paralegal. They took all my info and am waiting a call back. Yes believe me it seems to me they are trying to get rid of me...thanks Monte!

              Hey Guns--thanks for the reply..I thought things would be different when I returned but it seems like they are fking me...believe me I am the first one to be positive and be the stand up guy---12 years and I don't want to leave...moved traveled and did everything I could for these guys...was promoted several times and this has been tough...I can not trust my HR dept...they side with upper management..I have dealt with them many many times...it is always the bad associate--bad this bad that...now I am on the other side of the fence and it doesn't feel real good. It wasn't a job related injury either...You said I have a lot of rights...I have looked on line to get those rights but am unsure of who to contact...Monte says the EEOC---who else..I appreciate BC and you for the help..I don't want miracles Just want what is right---thanks!

Request that your employer provide you with reasonable accommodations that will allow you to perform the duties of your job. Request in writing what accommodations you will need.You will have to have your doctor provide medical documentation as to why these accommodations are necessary. If the employer refuses to accommodate you do what Monte suggested and go see the EEOC and tell them you want to file a complaint against your employer for failing to accommodate you disabilities. You may want to consult with an attorney or the EEOC before making your request for an accommodation to see exactly what you need to do. Good luck.

                      At first they did not do that--provide reasonable accomodations.now they are trying...here is my point..my job has changed which in 12 years was the same..I didn't have to lift things or do any physical work...now I come back and they make that part of my job..just seems off base.

                        I know this may sound crazy, but your area probably has a United Way, and you have probably contributed through your employer. Most United Way's have agencies that that specialize in family law or workman's comp cases. Call the United Way and ask them to refer you to an attorney that could handle this case. They should be able to recommend a reputable attorney that would handle your case. Many of these attorney's donate their time as part of their giving to the community.

                        The United Way is not what it used to be. That would be the first call I would make. You don't have to be a contributor to qualify

                        Monte already said this, but be very careful what you say at work. The less said , the better off you will be. You just never know who is on your side.

                          I just feel that they are taking advantage right now..I have had comments like they were pissed whn you got hurt...I have had additional comments from my superiors that I need to start doing this and that...after 12 years doesn't make sense...today in a meeting they asked if I was still walking with a cane or crutches....I said today a cane...yesterday crutches...I have been in so much pain I had to use the crutches yesterday---thanks for the reply

                            I am not a lawyer either, but here are a few things you must do:

                            1) get everything in writing; tell them you want to know why they changed your job detail --- when you ask them questions, ALWAYS put it in writing; make a copy for you, make a copy for them to fill in the blanks and make sure they give it back to you.

                            2) make sure you have everything in writing -- dates, times, with whom you spoke to, etc.

                              BRYCE, Have you asked them why or told them you came back assuming you had the same job and would be able to do it? If not, you need to just to see what they say. I agree with Monte, it sounds like they are trying to black ball you big time. I know in my dealings, going on disability was a bad thing for just about everyone i've known. It is step 1 of their process to get rid of you.
