    Back in September the company I work for shut the warehouse my wife and I work in down.

    They transfered us to different facilities given me the same job and her a different one from the one she was doing.


    Let's start with her:
    Forgetting the fact that she hasen't been to work since breaking her leg October 1st (she's on workmans comp), here's the problem.
    She was a "reciever" and is now a "loader." Loaders make less than recievers, but she was transfered at the same pay. It was a take it or resign deal she had to sign. She wasn't the only reciever that they made this same "deal" with.
    Now, two months later they are cutting those peoples pays by $1.50/hour. They try justify this by saying that the loaders now have less responsiblities than both recievers and less responsiblities than loaders did 2 weeks ago (they cut some aspects of a loaders job).

    Can they do this? Why can they do this?

    My problem is a little harder to type. But basically trying to do the same things, only I have more responsiblities with a quota I never had before. I am in a position that I turned down 2 months before being forced to do it.

        My company just paid out a $750 million dollar class action lawsuit this week for miscalculated overtime.

        My wife and I are expecting our checks soon for that.

                I can't mention the name of the company in this thread. Since I mentioned the law suit in which i was a part of I have a gag order.

                    Meaiken,

                    Are you non-union or union?? If you work for a union they may have negotiated the whole deal with the pay decrease with your company. If that is the case, I doubt there would be much you could do. If you are non-union, than you would proceed differently of course.

                    Since you were a recipient of the prior class action suit, they may be trying to force you or your wife out by using these kind of tactics. You need to document everything you can in case you need to bring in your own attorney.

                    My Father is an Attorney, I will check with him once you let me know your union status and whether on not this was negotiated by them.

                      Did they reclassify the job. Did they change the job description? If they did they could justify that there was a change of duties hence the change in pay rate. I work in the distribution field and if you would like you can get my email from Monte and we can discuss further. I imagine this is a non union environment as well.

                          Every employee between a certain worktime was part of the law suit. Even some supervisors got a settlement. They sent us the paper work. I didn't even know about it till I got it in the mail.

                          I am not sure if they reclassified the job, but the discription i believe is the same. What will happen is, they take away duties now, but I will gaurentee they will add them back on again.

                            I am a manger for a fortune 500 company we expect all our associates to do what is asked of them whether it outside of their job description or not. The phrase "it is not my job" is not accepted in my facility or any others across the nation. In the same respect I don't think as a company that we would cut wages when some responsibilities have changed. It would make sense that is some responsibilities were taken away then some associates would have some extra time on their hands and this would be filled by other responibilities to ensure the associate was working at a full capacity. I don't know maybe I am missing something but something doesn't seem right here...just seems like they are try to have a hard cost savings somewhere and this is the place.
