  • Can services sue for posting plays?

    I know that many newbies worry about this when posting in the service thread but maybe some of the veterns here and the mods can give some clarity to this topic.

    My understanding is that they can't and claiming to be able to sue someone over it is a legless attack.

    I don't think they can. It's just a scare tactic. It would be like you buying a newspaper and telling about one of the articles. The paper can't sue your for talking about it.

      You can't be sued for posting their plays on the site, but you can be sued if you post any analysis that they have. Thats copyrighted material, like posting the contents of a book.

      As far as just the plays, those are opinions and can't be copyrighted.

        I agree about WHY they picked a game can't be posted and it makes sense about that having a copyright but as for the actual teams.......bull shit

          They don't have copyright protection for either Profesional or the Collegiate Team names.

              In some cases yes they can

              If you are a subscriber to the goldsheet and you post thier picks on a website for free with thier analysis, you are in copyright infringement violation. Most services do not care to copyright thier name, I for one have copyrighted TY GASTON,a nd my likeness (picture). If someone uses my name or poses to be me, yes they can be sued for doing so.

              8 years ago HBO used my likeness and name in a sport services report that bashed several sports services. They did not bash me but used my pictures and name when they showed dozens of sports services ads from the USA today. My attorney notified HBO after the first airing, that my name and likeness were copyrighted and they were infringing on my copyrighted pitcure and name, HBO edited the segment and did not use my pictures or name in subsequent airings. We did not sue as they did not say anything derogatory against me.

              For someone like the goldsheet, yes they can sue someone if they choose to, if the copyrighted material is posted as printed by the goldsheet, but I doubt if the goldsheet would sue, unless the material becomes published illegally every week, then it may piss em off, and then who knows

                Ty-the key word is "analysis"-to post picks without analysis in my opinion would constitute no basis for a lawsuit because names of teams(picks) cannot be patented and/or copywrited.

                    I have an opinion that does not have copyright protection. Ty Gaston is a large pile of excrement that begs for people's hard earned money because he can't make it on his own. That is of course my humble opinion. FAQ Ty
