    Filing claims syringes will test positive for Clemens' DNA

    Tests of syringes and other steroid paraphernalia that trainer Brian McNamee submitted to federal agents will test positive for Roger Clemens' DNA, according to a brief filed in court by McNamee's lawyers.



    Although there has been considerable speculation about the materials McNamee submitted to federal agent Jeff Novitzky in January, his attorneys had refused to discuss them publicly until the filing of the brief.



    The brief, in support of McNamee's attempt to obtain an early dismissal of a defamation case Clemens filed against him or have the case moved to New York, was filed in court on Tuesday.



    The paraphernalia, including syringes and bloodied gauze pads, "will test positive for Clemens's DNA," the brief asserts. "Once the DNA results are revealed, there will be little dispute about who is telling the truth."



    E-mail and voice mail messages left Thursday for Clemens' lead attorney, Rusty Hardin, and two other lawyers in Hardin's office were not immediately returned.



    At the time the existence of the evidence became public, Clemens' lawyers claimed it was "manufactured."

    McNamee's attorney, Richard Emery, said McNamee kept the items -- dating to 2000 or 2001 -- because he "had this inkling and gut feeling that he couldn't trust Roger and better keep something to protect himself in the future."



    Clemens claims in his lawsuit that McNamee defamed him with false allegations that McNamee injected Clemens with HGH and steroids, as part of his testimony to Congress and in the Mitchell report on the use of performance-enhancing drugs in baseball.



    The case originally was filed in Texas state court and was shifted in February to the U.S. District Court in Houston.



    McNamee wants the case dismissed or transferred from Houston to New York. Emery argues that federal agents and a congressional committee have determined that McNamee has been truthful.



    Emery's defense also relies heavily on statements from Clemens' former teammates Andy Pettitte and Chuck Knoblauch that confirmed what McNamee said about them and their use of performance-enhancing drugs.



    It is anticipated that U.S. District Judge Keith P. Ellison in Houston will rule on McNamee's motions in August or September.



    McNamee's lawyers first tried to dismiss the case in early March. When Clemens' lawyers responded on May 27, they added a new claim of "intentional infliction of emotional distress" and two additional claims of defamation.



    In the latest filing, McNamee's lawyers said New York has the most interest in this lawsuit and that many of the potential witnesses reside in New York. McNamee claims no defamation took place and that it would be a burden for him to defend the case in Texas. According to the filing, McNamee earned only about $3,000 between January and June of this year.



    McNamee also claims that he is immune from defamation because he made his comments to former Sen. George Mitchell, who led baseball's probe into performance-enhancing drug use, at the behest of federal prosecutors.

          It is so unbelieveable. By digging his feet in the sand and taking a stand, he thought he could fool everyone. If he did what Pettitte did and said yes, i used a couple of times because of this or that, it would have been forgotten about already. His biggest mistake was calling out the wrong guy in Mcnamee!

            I really hope he gets exposed as a complete fraud. He'll probably get pardoned by his buddy Bush, but hopefully he'll get what he deserves.

                  Bonds & Clemens biggest problem was that they were TOO successful. They tried unsuccessfully to protect their legacy, and Clemens found out that when you point the finger at someone else, you have 3 more fingers pointing back at you.

                  I think the lies on top of the roids make enough it to keep guys like bonds, clemens, palmeiro etc,. out of the hall of fame.
                  AT LEAST PETE ROSE WAS HONEST!!! ......and its not like he bet AGAINST his team

                      Pete Rose lied for years. Espn was on Bonds for years and treated Clemens like a God.The only reason they don't continue to dog Bonds is because they would have to do the same for Clemens.ESPN is trying to save face...What a joke !!!

                          Ahhhhhh----I can remember the "good old days","when it was a game", and "baseball was truly baseball".......

                          Players rode busses, had dirty uniforms, no lounge chairs in locker rooms, no steroids, instead a steady supply of BEER and HOT DOGS.....

                          When they day was over, and they took a piss, their bodies were clean of all BS.....

                          Less selections of bats, smaller gloves, duller baseballs, used over and over in some cases....

                          Players respected each other, played hard, visited with fans, signed autographs (free), just played the damn game.....

                          Sure there were some scandals, but you didn't hear about drug enhancements.....Todays athletes, have the best of training equipment, spas, hot tubs, medical staff, the Old guys had Neosporin, babdaids, gauze, peroxide, and the only weights lifted, were when they got a Keg from (PJ) to enjoy themselves after the game....hell, some times during the games....

                          The almighty $ has taken a heavy toll, on Americas #1 Sport....we still have Chevrolet and Apple Pie.....looks like Chevy is struggling also (economy), and Apple Pie is gonna go up cause of the fuel cost to bring em to other states.....

                          Hang in there BaseBall.....the Old Kaptain still loves ya, and wish we could turn the clock back for just a little while....so some of the younger guys could see some of those games, and enjoy the hell out of it....

                          Pitchers pitched complete games.....Mid reliever, set up man, closer----what in the hell is that......some pitchers even pitched double headers.....

                          Times change, and generally for the better, and I'm for changes for the better, and usage of modern equipment, but DAMN, I remember the good old BaseBall games and Players....

                          You had to have been there fellows....If you get a chance, get the CD's of "When it Was a Game".....great watching.....Best to all

                            Pete Rose was honest????????????? Where were you when this was all going on? Pete Rose's inability to be honest kept him out of the Hall of Fame and sent him to prison for tax evasion. I guess that must be considered honest by today's standards. What a joke!

                            Clemens is making the same mistake Nixon made. Just tell the truth and at least there would be no legal ramifications. He could do enough damage control to save his legacy, if he had been honest from the start. Now it may be too late.
