        Recent Allegheny County ruling
        Pittsburgh, PA (AP) - A seven year old boy was at the center of a Pittsburgh courtroom drama yesterday when he challenged a court ruling over who should have custody of him.

        The boy has a history of being beaten by his parents and the judge initially awarded custody to his aunt, in keeping with the child custody law and regulations requiring that family unity be maintained to the degree possible.

        The boy surprised the court when he proclaimed that his aunt beat him more than his parents and he adamantly refused to live with her. When the judge suggested that he live with his grandparents, the boy cried out that they also beat him.

        After considering the remainder of the immediate family and learning that domestic violence was apparently a way of life among them, the Judge took the unprecedented step of allowing the boy to propose who should have custody of him.

        After two recesses to check legal references and confer with child welfare officials, the judge granted temporary custody to the Pittsburgh Pirates, who the boy firmly believes are not capable of beating anyone.

            scouting report

            Cards vs Cubs
            Marquis' eight-inning stint, in which he gave up just five hits and allowed no runs against the Dodgers on July 23, displayed his sinker and his fortitude. The former stayed down, and the latter stayed up in 92-degree heat, producing his 12th victory and putting behind him a disastrous outing against Atlanta five days earlier in which he ate innings for a fatigued bullpen and mainly found the middle of the plate as the Braves touched him for 12 earned runs on 14 hits.

            Marmol had to leave his last outing against the Nationals after 3 2/3 innings because of a bruised hand, which he hurt during his at-bat in the game. The rookie has only faced the Cardinals in a two-inning relief appearance on June 4.


            Bos vs LAA
            Escobar came off the disabled list on Saturday and made his first start since July 6 after a bout with inflammation in his elbow. Escobar gave up three runs on five hits in the first inning, but nothing after that -- allowing four hits over six scorelesss innings -- before departing after 98 pitches and seven innings. Escobar did have a blister on his middle finger, but said it should not prevent him from missing his next start.

            Lester was not sharp in his last start, yielding eight hits and five runs over five innings in a no-decision against the Mariners. Still, he was in position to get the win in that game, but Manny Delcarmen blew the lead in the seventh inning. Lester is unbeaten in his first nine Major League starts. In five Fenway starts, he is 3-0 with a 2.22 ERA.


            Pgh vs SF
            Schmidt picked up his first win since June 6 in his last outing against the Padres at AT&T Park in San Francisco. The right-hander gave up three runs on six hits over six innings, striking out five in the process. Schmidt is 4-1 with a 2.08 ERA against Pittsburgh in six career starts.

            With a little offense and some defensive support, Wells could have picked up his first win of the season in his last start against the Marlins. Instead, Wells took another loss after pitching a solid 5 2/3 innings in which he gave up three runs, a total that could have been far larger if the veteran righty hadn't gotten himself out of some jams. Wells is 0-5,8.28 ERA

            NYY vs TB
            Corcoran had the shortest start of the season on Saturday, logging just three innings while allowing three runs on seven hits and four walks. He was spared from the loss when his teammates scored 10 runs in the fifth. The right-hander has had a combined seven earned runs in his past two starts, three more than he had all season (seven appearances) up to that point.

            Wang didn't have his strongest outing in his last start, but kept the Yankees close enough to win. He allowed four earned runs and 10 hits in six innings, which is below Wang's high standards he has set this season. Wang is 2-3 with a 4.97 career era against the Devil Rays.


            Mets vs AT
            Martinez's return is scheduled for one month after his most recent start, in Fenway Park on June 28. Martinez has lost four of six decisions in 11 starts after winning his first five starts. Two of those five victories came at the Braves' expense in April. They're a different offensive team now. And who can say how he'll pitch on 29 days' rest?

            Ramirez earned no decision after limiting the Phillies to just one earned run in seven innings on Sunday night. He induced 14 groundball outs, including three double plays, and just two of his 21 outs were recorded in the outfield. He has allowed three or fewer earned runs in eight of his past 10 starts.


            KC vs Tex
            Hudson hasn't had a subpar outing since joining the rotation July 7. He rebounded after a tough first inning Saturday against the Angels, allowing three runs and five hits in 6 1/3 innings to get the no-decision. Hudson threw 96 pitches in that game and continues to build up his stamina after spending most of the year as a reliever.

            Padilla is 4-1 with a 2.02 ERA in his last five starts. Opponents are batting .189 off him in that stretch and in 35 innings, he has struck out 29 and walked seven. He is 6-2 with a 3.80 ERA at Ameriquest Field in Arlington this season. Left-handed hitters are batting .295 off him and right-handers are hitting .197. Opponents are hitting .219 off him with runners in scoring position. He has never pitched against the Royals.


            Det vs Minny
            Though Miner has lost just once over his last eight starts, he has struggled in his last four as opponents have caught onto making him coming over the plate with his pitches. He was out after 2 1/3 innings Saturday against Oakland, having surrendered five runs on seven hits. He hasn't lasted through the sixth inning since his complete-game win, June 20 at Milwaukee.

            Liriano was electric, but not efficient, in his last start against the Indians. He struck out 10 in five innings and gave up only four hits, but he was forced to throw 95 pitches in those five innings, including well over 20 in his final frame. The rookie phenom has struck out 125 hitters in 107 innings.
