    Supreme Court setback for Mumia Abu-Jamal
    Justices throw out a ruling that had set aside the death sentence of the former Black Panther, convicted of killing a police officer in 1981.

    Philadelphia - The Supreme Court on Tuesday threw out a ruling that had set aside the death sentence of Mumia Abu-Jamal, convicted of killing a Philadelphia police officer in the 1980s in a racially tinged case that has made the former Black Panther an international cause celebre.

    The justices ordered the U.S. 3rd Circuit Court of Appeals in Philadelphia to revisit its 2008 ruling that Abu-Jamal deserved a new sentencing hearing because of flawed jury instructions.

    The Supreme Court pointed to its decision in an Ohio case last week, when it said a neo-Nazi killer did not deserve a new sentencing hearing on those grounds.

    A mostly white Philadelphia jury convicted Abu-Jamal of killing white Officer Daniel Faulkner in 1981.

    Prosecutors think Faulkner and Abu-Jamal exchanged gunfire after Abu-Jamal's brother was pulled over in a traffic stop. A wounded Abu-Jamal, his own gun lying nearby, was still at the scene when police arrived, and authorities consider the evidence against him overwhelming.

    But he maintains his innocence. Since his conviction, activists in the United States and Europe have rallied in support of his claim that he was the victim of a racist justice system.

    The issue over jury instructions relates to whether jurors understood how to weigh mitigating circumstances that might have kept Abu-Jamal off death row.





    What a liberal slant on even this story, "a mostly white jury"

    Are they insinuating that white jurors cant make a judgement on the case without race bias



    Anyone who knows anything about this case in which there were eye witnesses know this guy should have been sent to the gas chamber years ago. The out of touch celebrities who took up his side and wanted him free are really dispicable.



    These are the facts of this tragedy:

    On Dec. 9, 1981, Officer Faulkner made a traffic stop on Abu-Jamal's brother, Billy Cook, who put up a fight. Abu-Jamal happened upon the scene, and shooting began. Faulkner ended up dead, and Abu-Jamal was shot in the chest.

    A gun registered to Abu-Jamal, with five chambers empty, was on the sidewalk. Four witnesses who saw all or part of the shooting implicated Abu-Jamal. One witness said that after Faulkner went down, Abu-Jamal stood over him and sealed the deal with a bullet through the head.

    And yet an international crusade to free Mumia--fueled by endorsements from Hollywood celebrities including Susan Sarandon, Paul Newman, Ossie Davis, Ed Asner, Tim Robbins and Alec Baldwin-- has had people marching in the streets from Africa to Asia and beyond.

    This is where you and I are at completely opposite ends. To say that is a Liberal slant is ludicrous. You have no news writing knowledge to make such a claim. None.

    That is an accurate description of the jurors. Anytime you are writing a story you are taught to paint a picture to the best of your abilities. If it was a mostly white jury, the people reading the story should be privy to that.

    No reporter or editor that's has any clue would leave that out or delete that from the story. It's an essential element in ANY court story to include a description of the jury. Esp in a death penalty decision from the Supreme Court. It has zero to do with being Liberal.

      What makes you think you know anything about my news writing knowledge? This is the problem with Lib journalists, they are not supposed to be writing a "story", this is supposed to be "news". Stories like this are why dumb ass celebrities start hating cops and the legal system.

        Why does it always have to be about race man? You guys are the ones always bringing it up and talking about the "double standard."

        If this was a black guy that got acquitted by an all black jury or mostly black jury for murdering a cop, and the story made NO mention that there was a mostly/all black jury, you'd be the first in here complaining that the story was Liberal bias because the writer didn't say anything about the jury's race.

        And I would be just as pissed if they left that detail out of the story if the table was turned. Any news writer knows, and you can ask any one of them, you most definitely include in a story like that, that it was a mostly white jury. You write to be as descriptive as possible on ALL accounts. Either way. You are painting a picture for the reader.

        FWIW.....I'm not a news writer.

        And I know you're not a news writer. A news writer knows the difference between "your" and "you're".

                  Kaz, I can tell that you are not a professional writer. A professional would not point out spelling or punctuation errors unless they are attempting to deflect the attention from the text of their message.

                  Psychology suggests you feel you are slightly superior, yet insecure by publicly mentioning a slight spelling error.

                  Anyway, I agree with a lot of what you say. Trying to demean others in a public way is not a subject we agree on.

                    I was making a joke out of his error, hence the after I said it.

                    And no Flare I'm not a news writer, but I've been in the journalism profession for the past 25 years. Does it make me qualified to answer what a news writer should and shouldn't do in a news story? I would hope so....

                    The only prejudice was yours because you see race as an issue in just about everything you see. It's always black and white with you. Somehow you feel like you're getting a bad deal because of the color of your skin.

                    And, I was merely pointing out an example if the situation was flipped. If it was an all black jury and he was acquitted, and there was no mention of the jury being black, you would have been in here complaining about that.

                    The job of a news writer is to be descriptive. Calling it a mostly white jury was descriptive and 100% correct as far as how the reporting should have been. If the writer left it out, the first question asked would have been, what did the jury look like?

                              You will never get it Raceman. Why would an article mention a mostly white jury??? Cant answer that without going off on your usual tangent. Looks like the race card gets thrown out and when I call em on it you get all defensive.
