Yeah that's the play I was talking about..right now that play has been ruled as a sack. Would be 80 bucks richer if it wasn't

According to the box score,

Kaepernick was sacked 1 time for 7 yards
however
team totals showed 2 sacks for 11 yards

so officially it must be a sack
