Report: Roger Clemens to be indicted

Roger Clemens will be indicted on charges of making false statements to Congress about his use of performance-enhancing drugs, The New York Times reported, citing two sources briefed on the case.

An announcement of the indictment was expected shortly, according to the report.

Clemens and his former trainer, Brian McNamee, testified under oath before the House Committee on Oversight and Government Reform in 2008. McNamee, who cooperated with federal authorities and with baseball's Mitchell report on performance-enhancing drugs in baseball, said Clemens had used steroids, while Clemens flatly denied having ever used them.

A few weeks later, the FBI opened a perjury probe against Clemens, a seven-time Cy Young Award winner. The federal grand jury began hearing testimony more than 18 months ago.

Rusty Hardin, Clemens' lead attorney, said he was unaware of a pending indictment.

"We've heard nothing," Hardin said by telephone from Houston, "so I can't knowledgeably respond at all."

Earl Ward, one of McNamee's lawyers, said he, too, "had no indication something was coming."

McNamee, a one-time New York City cop and former close friend of Clemens, said in the Mitchell report that he injected the 354-game winner with steroids and HGH at least 16 times in 1998, 2000 and 2001. He repeated the claim under oath before Congress, but Clemens, also under oath, adamantly denied the allegations.

Some of McNamee's evidence is believed to include bloody gauze, vials and needles that he claims contained steroids and Clemens' DNA. McNamee kept the decade-old evidence in a FedEx box at his New York home and handed it over to investigators after the probe began.

Clemens sued McNamee for defamation, but a federal judge in Texas dismisseed most of Clemens' claims against McNamee last year. Earlier this month, a federal appeals court affirmed the decision,.

McNamee has filed a defamation suit against Clemens in federal court in New York.

ESPN.com investigative reporter Mike Fish and The Associated Press contributed to this report.

Clemens deserves everything he gets. He brought this all on himself. Martha Stewart got 6 months for the same type charges so don't be surprised if Rog goes away for a few months. If he wasn't such an arrogant ass he would plea bargain for a slap on the wrist sentence. Instead he will probably go to trial and subsequently to a minimum security Federal prison.

So let me get this right.. Everything I read and am watching is saying Clemens opened his mouth voluntarily. Do you mean to tell me that he wouldn't have been called on eventually anyway?

Legalize PED’s. They make pitchers throw harder, they extend careers, they give guys more home runs, they cause more spectacular plays to be made, and they’ve been being used since the 30’s--on top of that, they’re still being used anyway......Used responsibly, they can extend a person’s prime, extend a person’s life, heal injuries more quickly, regrow hair, heal osteoporosis--literally reverse aging. Look at Sylvester Stallone at age 63. The fuckstick is in better shape than I am. As soon as I turn 35, you can bet your ass I’ll be cycling PEDs. And by then they’ll be even better for you because of the technological boom we’re going through......

And really, who cares? It’s just a glorified game. A baseball player should not be dealing with the FEDS because he might possibly have lied about shooting steroids into his ass in order to play a game better. Gay, gay, gay!!!!

Seriously.....I can’t believe Congress still cares about Clemens’ steroid use when we are fighting two wars, the economy is still in the shitter, and America’s faith in government is at an all-time low.....

I personally could care less if Clemens goes to jail for lying about steroids or not. This so-called steroids witch hunt in baseball is not going to make me stop watching the games. In fact, attendance in MLB has gotten higher since these steroid revelations have come to light......Furthermore, if baseball is going to be singled out, then maybe if Congress wants to do something better with their time, they should go and prosecute NFL players. That will give them something to do for the next, oh, 20 years. I love the NFL and all, but I am not naive to the fact that more than 50% of the players use PED’s and that will NEVER change.

Yea Bryce he did this voluntarily. Clemens was told that he didn't have to testify in front of Congressman Waxman and Davis. Congressman Davis who liked Clemens told him that if he was set on testifying just make sure not to lie. I am not a lawyer but I am sure if he was called against his will to testify he could have pleaded the 5th. So Rog has nobody to blame but himself

                    I agree with you completely.
I say keeping him from the HOF and banning him from baseball is sufficient.
Too many other horrible and in many instances needless atrocities happening in the world to get overly concerned with this-sort of reminds me of Clinton/Monica.

Based on what? Without a trial and guilty verdict, what exactly could they ban him from the game for? He failed no tests like Bonds and he isn't banned from baseball. I would love to see Roger spend a few months behind bars just for being the pompous ass he is through all of this but to ban him from baseball & the HOF, you need to have some sort of hard evidence to do it.

                        Actually I agree with you.
My point is that if they had to choose between a prison sentence for a number of years as opposed to being banned from baseball, I would rather see him banned from baseball and the HOF.
In reality I say the whole investigation was absurd in the first place and a waste of time and money relative to what else goes in our society and the world.

Do you have a link about using PED's since the 30's? I don't think they were even around then.

PED's are only safe(?) if a ************ by a Doctor is given to you and they do a full blood check up very often to make sure that it's not effecting your body in bad ways.

He should not be banned from Baseball as that douche McGwire is back after he took the 5th I believe. Or did his ass lie to congress as well? McGwire isn't getting into the HOF either. Not sure about Clemens as I'm 50/50 on whether he gets in or not.

What is BS is ARod gets busted for steroids after lying and look at his #'s since then. He's a 30-40 HR's per year and 100-125 RBI's a year which makes a big difference over a career. Which is still really good, but a huge difference as he wouldn't be at 600+ Hr's right now. Just like Manny Ramirez may not make it to the 600+ club.

how can someone be banned from baseball when he never failed a MLB drug test.

baseball is so stupid, should have never done mitchell report/witchhunt. they bred the PED culture, but want the players to pay for it. what a joke. FUCK YOU Selig.
