Roethlisberger Won't Appeal

JC, Chances are, her little lawyer would have no shot vs Ben's million $ lawyers if she did go through with it. She was drunk by her own admission and the details and memory are somewhat sketchy. Ben has all the off duty officers and bodyguards who guarded the door speaking on his behalf and a trial would do nothing but drag her and her name through the mud. She would really have nothing to gain by going through with it and she would very likely lose anyway. The prosecution cannot file a charge on Ben if she is the main witness and refuses to testify so they had to drop it. She was in a 18 and over club and she was not 21. Ben knew that because the 18-20 year olds have bracelets put on their wrist so people know they are not of drinking age. Ben fed her drinks all night anyway. She, of course, became drunk. With nothing to gain and everything to lose, a trial is somewhat useless to her at this point.

What's the next best thing? If you know you basically have no chance at a guilty verdict in a trial, you make him pay for what he did in a civil suit. The key here is that you CAN NOT file a civil suit if there are criminal charges pending. Well, since there are no criminal charges pending because of her unwillingness to go forward with it, it opens the door for a civil suit and she has a GREAT chance to get rewarded some money if that happens. Ben would want to end that one quickly and quietly and in the end, she would get finacial justice for what happened that night and Ben moves on.

Wayne, all of that is fine and good, but did he RAPE her. Feeding her drinks all night and having sex doesnt = rape.

Rape is the crime of forcing a woman to submit to sexual intercourse against her will.

Did he force her into the bathroom, did he leave bruise on her by forcing her in there? So state troopers are going to lie under oath for Ben that he didnt man handle her into the stall?

I understand he has money, so did Mike Vick, look what happened to him. If she was physically forced into sex then the evidence doesnt lie because Ben is rich.

Is Ben a pig for preying on a 20 year old, yes he is, but I dont just agree with throwing the rape word around so quickly. She has some culpability here, she opened her mouth for the booze, I doubt he pulled her by the hair into the bathroom.

I am not defending him, I would say the same thing about anyone with the evidence I have heard.

Not going to argue with all of you all on this matter, its just my opinion which dont mean shit anyways. If he did rape her, I hope the bastard does get his knee blown out by a blitzing linebacker, but if he just used his clout to score some easy ass, he is just a fucking pig and no different than most athletes who feel they are entitled to free ass. A close friend was a victim of abuse when she was 12. She was abused by her step-dad. She's now 37. She has suffered for 25 years. Mostly quietly. Over the last year she's been in therapy. In that time I've gotten to know many of the patients in her therapy. When you hear their stories of rape. When you hear their nightmares. The history of alcohol, drugs, lack of trust etc due to the abuse or rape is sad. Most suffer silently. 84% of rape victims do not report the crime.

In my friends case when the abuse came out the guy was arrested. Some of her family and friends convinced her to tell the police she made up the story so the charges would be dropped.. The step-dad's family were calling her a whore. SHE WAS 12!

So please refrain from making ignorant and uneducated opinion on this issue.

JC, I used to think this exact same way, but when you get beyond this surface reaction I can tell you things aare a million times more difficult than you would imagine. I hope that nobody you ever know has to go through anything like this, but I can tell you the decision is MUCH more difficult than you think. Until someone you know is in this situation it is hard to say how you react. As I mentioned earlier, rape victims often times would rather put this behind them then to have to drag it out for a year or so in the legal system. It is much harder than it would seem on the surface to tell your devastating story in front of a bunch of strangers. It would be very difficult to get up in front of strangers and talk about such a life altering and personal event.

Now, when you are dealing with a celebrity as your attacker, this is all a million times more difficult. If she were to press charges she would have TMZ, Enquirer, etc camping out in her town. Interviewing her friends, old boyfriends, coworkers, old teachers, etc. You entire life becomes public record and the other side will do everything in their power to smear herr name. Remember that one night you made a mistake and had a one night stand? Well, that comes out and she is portrayed as a whore. You were drinking on the night in question? Well, that means you are drunk and you don't remember really what happened. Oh wait, she is just making this us up to sue him and make some easy money. I mean the list goes on and on and it just constantly keeps victimizing the victim even further.

While obviously I can't say for sure Ben is a rapist (I am certainly entitled to my opinion, and my opinion is that he is a sexual predator), please don't confuse her lack of pushing this case to mean nothing happened. Let me ask you this, let's say she never pursues a civil case, what would be her incentive to be making this up?

Yeah JC, we just have a difference of opinion on whether or not he assaulated this lady. As you pointed out, of course neither one of us know what really happened. I happen to think he assualted her and you disagree, which is cool. My only point in responding to your statement was the part where you indicated that if she was really then she would be pushing this. I was simply pointing out that more times than not rape victims don't report and push the issue for many different reasons.

I think we are on the same page that if he did assault her then he will eventually get his. I'll also admit that I hated Ben long before it was cool to hate him. Even before all the locker room reports started coming out I pegged this guy to be a drama queen and an asshole.
